One explanation for Trump’s popularity on the political right is that supporters are attracted to him because they feel invisible to “establishment” candidates and Trump, as an “outsider” is going to “shake things up.” A survey of 3,037 Americans completed by RAND, weighted to match the US (citizen) population, suggests that there is something to this.

About six months ago, RAND asked respondents if they agreed with the statement “people like me don’t have any say about what the government does.” Responses among likely Democratic voters didn’t significantly correlate with support for either Sanders or Clinton and those among likely Republican voters didn’t significantly correlate with support for Rubio or Cruz, but responses did correlate dramatically with a preference for Trump. All other things being equal, people who “somewhat” or “strongly” agreed with the statement were 86% more likely to prefer Trump over other candidates.

“This increased preference for Trump,” RAND explains, “is over and beyond any preferences based on respondent gender, age, race/ethnicity, employment status, educational attainment, household income, attitudes towards Muslims, attitudes towards illegal immigrants, or attitudes towards Hispanics.”

Whatever else is driving Trump voters, a sense of disenfranchisement appears to be a powerful motivator.

In early 2009, I had dinner with a prominent, conservative political operative. He calmly (and accurately) predicted that the 2010 mid-term election would see the largest Republican gains in half a century. He then leaned in and half-whispered, “but you haven’t seen anything yet. Just wait until 2012 .” I pressed him on specifics, but he would only allude to a campaign that would rewrite the political rules. With the revelation that a centralized, state-by-state voter suppression campaign is underway, I now know what he was alluding to.

The New Voter Restriction Laws

In 2011, a sudden wave of state-level voter restrictions in Republican-controlled states has swept the nation, just in time for the 2012 election, with 19 new laws and two executive actions on the books. Some of these laws reduced or eliminated early voting, while others did away with weekend voting and same-day registration. All 50 states require voters to prove their identification at the polls, but 17 states have pending or approved law mandating government-sponsored IDs in order to vote, despite the fact that approximately 11% of citizens don’t have such IDs (for various reasons). For some Americans, even those with ample resources, getting an ID can be quite a challenge (even for nuns!).

The Brennan Center for Justice estimates that 5 million eligible voters face disenfranchisement from these new voter ID laws.

 

Voter ID laws disproportionately affect Black AmericansLatino/a voters, U.S. citizens who were born in other countrieselderly peoplepeople with disabilitiestransgendered people, and students — all of whom are less likely to have the required ID for different reasons. A 2006 Brennan Center study finds that 25% of Black , 16% percent of Latino/s, and 18% percent of elderly Americans lack the necessary ID. Some on the left have accurately likened these new laws to Jim Crow Era poll taxes because the expense involved in obtaining an ID place a disproportionate burden on many groups that have been historically disenfranchised.

What do all of these groups have in common? With the exception of elderly Americans who have shifted Republican in recent years (although they still comprise the most active voting group for Democrats), the Americans who will be disproportionately affected by voter ID laws all vote overwhelmingly Democratic.

There is little doubt, then, that voter ID efforts will affect the upcoming presidential election. The states that have restricted voting rights also have 185 Electoral College votes, two-thirds of the 270 needed to win the presidency. Out of the twelve battleground states in the upcoming election, five have already restricted voting rights and two others are considering new limitations.

Who’s Behind the New Laws?

The corporate organization behind the new spate of voter ID laws is the American Legislative Exchange Council (ALEC), which claims to be a “nonpartisan public-private partnership” between legislators, the private sector, and the general public to promote “principles of free markets, limited government, federalism, and individual liberty.” (How is requiring government-issued ID to vote a promotion of “limited government” and “individual liberty”?) In actuality, ALEC is a hyper-conservative Republican organization that receives 98% of its funding from corporate entities, such as Exxon Mobil, Atria (formerly Phillip Morris tobacco), AT&T, Coca-Cola, and the Charles G. Koch Charitable Foundation.

And ALEC is more than just a corporate lobbying organization. They work directly with legislators (who are ALEC members) to craft model legislation that is then introduced in statehouses across the country without acknowledging that corporations drafted the bill. ALEC drafted model ID voter legislation, and every single new voter ID law was passed with ALEC member involvement. ALEC’s policy agenda for 2011 included bills to deregulate polluting industries, privatize education, eliminate unions, and voting restrictions.

David and Charles Koch, two brothers who have quietly promoted their radical, free-market agenda with $100 million in contributions to conservative causes, including bankrolling Scott Walker’s election and subsequent recent assault on public unions in Wisconsin, have long ties to ALEC. Koch Industries has been one of a select group of members on ALEC’s governing board for nearly two decades, and from what little financial information is available, the Koch contribution to ALEC likely exceeds $1 million. The lead lobbyist for Koch Industries formerly chaired ALEC. Koch brother involvement in voter ID laws should be of particular interest for the Occupy Movement considering that David Koch’s project, Citizens for a Sound Economy, spearheaded the effort to repeal Glass-Steagall that enabled banking institutions to gamble in securities and tank the economy in 2008.

The purpose of new voter ID laws is to demobilize certain portions of electorate who are more likely to vote for Democrats, a goal laid out by ALEC founder, Paul Weyrich many decades ago who stated that “I don’t want everybody to vote… Our leverage in the elections goes up as the voting populus goes down.”

In short, this is a corporate-sponsored attack on democracy, spearheaded by Republicans intent on disenfranchising certain groups in the electorate in order to gain political control.

But Don’t We Need to Enhance Voting Security?

No. The voter ID movement is based on a bald-faced lie that voter impersonation is an issue. It’s not. As the DNC humorously notes, a person is 39 times more likely to be struck by lightning than to engage in voter impersonation, and 3,600 times more likely to report a UFO.

This voting fraud figure is based on a Bush Administration investigation into the matter that involved only 70 prosecutions nationwide, some of which were honest mistakes.

The Real Problem: Voter Turnout

We don’t have a voter impersonation fraud problem in the U.S., but we do have a voter turnout problem. Turnout in presidential years has declined since 1960, and pitifully hovers below 60% of the eligible electorate. We should be undertaking Herculean efforts to increase voter turnout, not erecting barriers to voting based on trumped-up problems to serve partisan ends. Yet, despite the data, untold resources are being spent to “correct” a problem that simply doesn’t exist. These new laws will cost taxpayers millions of dollars annually to implement, not including the cost of certain litigation. When a situation like this arises in politics, it means there are other motives at play.

We don’t need new barriers to voting, we need a state-by-state response with the concrete goals of getting people ready to vote, registering new voters, and overturning these laws.

In Locked Out: Felon Disenfranchisement and American Democracy, Jeff Manza and Chris Uggen discuss the implications of state laws that bar convicted felons from voting, some even after their release and completion of all parole or probation requirements. The result? Over 5 million Americans are prohibited from participating in the democratic process.

But because African Americans are disproportionately likely to be in prison, they are particularly affected by the restriction of voting rights. The Prison Policy Initiative posted this map by Uggen and Manza showing the percent of voting-age African Americans in each state prevented from voting in 2000 as a result of a felony conviction:

The pictures, of course, went viral. Donald Trump serving fast food, still in the box, to the college champion Clemson University football team. The cardboard containers and paper wrappers were artfully stacked on silver platters alongside ornate candelabras and embossed napkins and served on a formal table beneath a gold-framed portrait of Abraham Lincoln.

Sure the juxtaposition was glaring, and the media, the twitterverse, and the late night talk shows had a field day poking fun at the President’s seeming lack of class. The Washington Post headline quoted Patrick Guaschino, who accused the president of turning the “white house into a White Castle.” Comedian W. Kamau Bell joked that a white house staffer, “choking through tears [would say] ‘I guess we could use the Lincoln gravy boats for the McNugget sauces.’” My personal favorite meme photoshopped Ronald McDonald in place of the president.

These reactions also teach us something important about social class and “good taste.” Pierre Bourdieu famously wrote that “taste classifies the classifier (1984, 6),” and this insight has become essential to understanding contemporary American food cultures. In Discriminating Taste (2017), S. Margo Finn argues that the increasing fascination with “good food,” including trends toward the local, organic and artisanal, and the condemnation of fast and processed foods, are way for people to perform elite status. In a similar take on Foodies, Joseé Johnston and Shylo Baumann write that many foodies enjoy everything from high brow cuisine to street food, but often only enjoy fast food ironically (2010, 2012). And Julie Guthman (2011) and Charlotte Biltekoff (2013) offer contemporary and historical accounts of the ways that more affluent Americans have looked down on the food cultures and (always constrained) food choices of working class and immigrant groups as a way to boost their own cultural status and displace their own cultural anxieties.

Trump isn’t the only person who highlights our assumptions about food and social class. In an article that was just published in American Studies, media scholar Emily J. H. Contois examines Guy Fieri’s take on American food culture, arguing that he uses “unpretentious” foods, as well as his own bleach-tipped, tattooed presentation of self, to create a populist image that “speaks directly to eaters who oppose culinary elites and who experience a sense of disenfranchisement regarding their own sociocultural status.” Examining Fieri’s work offers a “method for considering the most recent rise of populist sentiment in the United States” (2018, 156). Her analysis aligns nicely with comedian Seth Meyers’ Late Night joke, which, playing on the fact that Trump said Burger Kings (plural) that, “had he lost the election, The Burger Kings would have been the name of the food show he would have co-hosted with Guy Fieri.”

Despite his own elite background, Trump has something of a masterful ability to appeal to white working class tastes, and to mobilize that group in opposition to political progressives who might actually work to improve their lives and livelihoods. Working class foods like burgers are part of the habitus through which these sort of Trump voters define themselves. To those who love fast food, serving it to football players might read like an embrace of their ways of being over the so-called cultural elites who (they believe) look down on them. Mocking Trump for this lends credence to this belief.

There is no shortage of reasons to object to fast food— land use and environmental degradation, worker exploitation, low pay, and the concentration of wealth in fewer and fewer hands—and, of course, there are no shortage of reasons to object to Trump’s behavior. But when we mock fast food culture out of context, we ignore the fact that many people have cultural attachments to these foods, and through them, tell themselves stories about who they are and what they believe in. As sociologists, I hope we can hear and empathize with those stories, rather than dismiss them.

According to a report from the Brennan Center for Justice, tens and sometimes hundreds of thousands of votes are rejected or miscast because of known bad ballot designs. Intuitive design is especially important because approximately 50 million people each year encounter a ballot design for the first time, either because they’ve moved, are new to voting, or because the ballot has been revised. People who are most vulnerable to ballot design disenfranchisement are people living in poverty, older voters, and new voters.

Some problems with ballot designs:

  • Including all instructions at the beginning of the ballot instead of alongside each task.
  • Passive voice; negatives.
  • Small or unreadable fonts, like this:

  • Unnecessarily complex language.
  • Listing candidates for a single office on multiple pages.
  • Including more than one contest per page.
  • Centered, all-caps, and dense text, like this:

  • Inconsistent use of font or failure to differentiate different kinds of information with shading or font.
  • Confusing indications as to how to indicate the voter’s choice.
  • Publicizing sample ballots that don’t match actual ballots.

There are many examples of good and bad ballots at the Brennan Center’s report, Better Ballots.

The Brennan Center asserts that these problems are easily identified. Unfortunately, many jurisdictions aren’t paying attention: very few pre-test their ballot designs to discover problems and few examine results of election to discover which counties’ elections are most undermined by lost and miscast votes. Some jurisdictions, moreover, are operating under laws that require the use of ballot designs that we know are bad and many are using voting machines that are not flexible enough to accommodate good design.

Good ballot design, the report emphasizes, is non-partisan, well understood, inexpensive, and simple to implement. It may not be the most scandalous way to lose hundreds of thousands of votes, but it’s a real and substantial problem, and one that can be easily fixed.

Black people in the U.S. vote overwhelmingly Democratic. They also have, compared to Whites, much higher rates of infant mortality and lower life expectancy. Since dead people have lower rates of voting, that higher mortality rate might affect who gets elected. What would happen if Blacks and Whites had equal rates of staying alive?

between 1970 and 2004, Democrats would have won seven Senate elections and 11 gubernatorial elections were it not for excess mortality among blacks.

At Scatterplot, Dan Hirschman and others have raised some questions about the assumptions in the model. But more important than the methodological difficulties are the political and moral implications of this finding. The Monkey Cage account puts it this way:

given the differences between blacks and whites in their political agendas and policy views, excess black death rates weaken overall support for policies — such as antipoverty programs, public education and job training — that affect the social status (and, therefore, health status) of blacks and many non-blacks, too.

In other words, Black people being longer-lived and less poor would be antithetical to the policy preferences of Republicans. The unspoken suggestion is that Republicans know this and will oppose programs that increase Black health and decrease Black poverty in part for the same reasons that they have favored incarceration and permanent disenfranchisement of people convicted of felonies.

That’s a bit extreme.  More stringent requirements for registration and felon disenfranchisement are, like the poll taxes of an earlier era, directly aimed at making it harder for poor and Black people to vote.  But Republican opposition to policies that would  increase the health and well-being of Black people is probably not motivated by a desire for high rates of Black mortality and thus fewer Black voters. After all, Republicans also generally oppose abortion. But, purely in electoral terms, reducing mortality, like reducing incarceration, would not be good for Republicans.

Compared to other democracies, the U.S. has a strange penchant for passing laws that suppress voting instead of encourage it.  We are one of the few democracies, for example, that requires people to register to vote.  Most elsewhere, writes Eric Black for the Minnesota Post:

[G]overnments know the names, ages and addresses of most of its citizens and… provide the appropriate polling place with a list of those qualified to vote. The voter just has to show up.

We also hold elections on just one day instead of several and that day is an otherwise normal Tuesday instead of a weekend or a holiday.

Those are just two examples of rules and practices that reduce voting. There are many. It’s called voter suppression and it’s totally a thing. The ACLU has collected voter suppression efforts just since 2013, listing 15 states that have passed such measures.

A majority of these efforts to reduce voting are initiated by the political right, as a generic search for such stories quickly reveals. They are aimed specifically at likely democratic voters, like racial minorities and students, adding up to what political scientist David Schultz argues is the Second Great Disenfranchisement in U.S. history after Jim Crow.

Many of these measures are overtly discriminatory and even illegal, but others are more subtle. Making voting more costly in terms of time might be one subtle way of discouraging voting by some types of people. Data collected by the Cooperative Congressional Election Study in 2012 suggests that this is, indeed, part of voter suppression, by incompetence or design.

Here is some of their data, as organized by Mother Jones. Nationwide, the average wait time to vote was longer for all non-white groups, especially blacks:

In South Carolina, the 10 precincts with the longest wait times were all in one disproportionately African American county:

Wait times are partly the result of the number of voting machines divided by the number of registered voters. The long wait times in South Carolina, in other words, were not random. Those 10 precincts in the highly African American county had about half as many voting machines per person as the statewide average:

Voter suppression seriously harms our right to call ourselves a democracy.  Notably, it’s significantly worse today. When the Supreme Court struck down the part of the Voting Rights Act that required oversight of states with a history of voting discrimination, the ability of the federal government to ensure equal voting rights was seriously damaged. Previously monitored states immediately began passing legislation designed to suppress voting. As I wrote previously:

This is bad.  It will be much more difficult to undo discriminatory laws than it was to prevent them from being implemented and, even if they are challenged and overturned, they will do damage in the meantime.
