A few decades ago, going to college seemed to be the surest route to the American dream, a path to greater opportunity for most young people. Yet today the U.S. system of higher education is evolving into a caste system with separate and unequal tiers. To be sure, more students from all backgrounds attend college and graduate with valuable degrees. But far too many from low-income and middle-class families depart early with no degrees and crippling levels of student debt. In early September 2015, Blanca Borrego, an undocumented Latina immigrant accompanied by her two daughters, arrived at a women’s health clinic in Texas for a routine gynecological exam. Sitting in the waiting room for nearly two hours, Blanca’s anxiety and impatience grew to the point where she almost walked out of the office. Eventually, Blanca was met by local law enforcement officials who escorted her out of the clinic in handcuffs for allegedly using a forged driver’s license during patient intake. Blanca’s eight-year-old daughter watched in tears while her mother was taken away and a deputy told Blanca’s eldest daughter that their mother would face deportation. Blanca remains in county jail on a $35,000 bond.

Scenarios like Blanca’s – highlighting the impact of race, class, and immigration status on reproductive rights – are not always brought to the fore. Although reproductive rights activists say they advocate for all women, difficulties faced by white, middle-class, heterosexual women get more attention than those experienced by women of color, immigrant or transgender women, or those with disabilities. However, a movement for reproductive justice has emerged by and for women of color that offers new possibilities to bring previously neglected issues to light. Key challenges include tackling the reproductive experiences of Latinas – and looking for ways to do more to address their needs in reproductive health care and policy.A movement for reproductive justice has emerged by and for women of color.

In June of 2015, the United States Supreme Court answered a question affecting millions of lesbian, gay, bisexual, and transgender Americans—by declaring that the right of same-sex couples to marry is protected under the U.S. Constitution and no state may deny that right. Like many previous issues, the gay marriage issue has polarized American public opinion, and so there is the same possibility that a Court decision for minority rights could lead to widespread backlash and outright refusals to obey. That is what happened following the 1954 Brown v. Board of Education decision outlawing racial segregation in schools and in the aftermath of the 1973 Roe v. Wade decision establishing abortion rights. In many states and localities, we can assume that the current Supreme Court ruling for gay marriage may also spark pushback from politicians, religious organizations, and interest groups. Most politicians and journalists discuss immigration laws and reforms – everything from comprehensive immigration reform to border fences – in ways that imply only individual immigrants are affected. But immigration laws that claim to target individuals in certain statuses – such as undocumented individuals – regularly have broader social consequences for families, neighborhoods, and work groups where, of course, immigrants and citizens are intertwined in daily life. This intermingling of citizens and immigrants is visible in all corners of American life, from university campuses to fast food restaurants and neighborhood parks. Immigration laws, especially punitive laws, affect those settings when co-workers and neighbors are deported or withdraw from social life in an attempt to avoid detection.

Nowhere are the reverberations of punitive immigration laws and policies more strongly felt than in family homes with immigrant parents, spouses, or children. Because families so often include people of different legal statuses, mixed-citizenship families provide a unique lens through which to study the true reach of laws regulating both citizenship and non-citizenship. Through these families’ experiences, we see the spectrum of immigration laws’ effects on families and communities. My research on mixed-citizenship couples allows me to explore the full range of direct and indirect effects of laws that appear to target only non-citizen immigrants but actually affect many citizens at the same time.Immigration laws regularly have broader social consequences for families, neighborhoods, and work groups where, of course, immigrants and citizens are intertwined in daily life. more...

The American abortion debate features “pro-life” activists wielding pictures of fetuses and “pro-choice” advocates telling horror stories about women forced to travel for hundreds of miles to access safe abortions. The struggle seems an irresolvable moral conflict – and both sides claim to be “pro-women.” Pro-choice organizations advocate that abortion be kept legal and made increasingly accessible because women have the right to privacy in matters of reproduction. Pro-life groups argue that the acceptance of abortion unjustly pits women against their children.

My research takes stock of activists on both sides – and identifies those that focus not just on the moral aspects but also on the socioeconomic context of abortion. In fact, abortion is mainly an issue for less privileged women, and if more pro-life and pro-choice groups recognized the economic realities, there would be possibilities for compromise.  more...

Strict voter identification laws are proliferating all around the country. In 2006, only one U.S. state required identification to vote on Election Day. By now, 11 states have this requirement, and 34 states with more than half the nation’s population have some version of voter identification rules. With many states considering stricter laws and the courts actively evaluating the merits of voter identification requirements in a series of landmark cases, the actual consequences of these laws need to be pinned down. Stigma refers to social views or treatment that undervalues people for having conditions like mental illness, or for engaging in behaviors such as substance abuse. Specifically, stigma happens when people express prejudicial views toward such vulnerable groups or take prejudicial actions. Individuals who are stigmatized may try to limit the effects of stigma by withdrawing from others, hiding aspects of themselves, or avoiding situations where their vulnerabilities may be revealed. Scientific studies increasingly find that worries about being stigmatized – along with actual experiences of stigma – adversely affect health and psychological well-being and keep vulnerable people from using preventive health care.

Even common experiences can make some people vulnerable to stigma. Although unintentionally becoming pregnant and having to make decisions about how to proceed with an unintentional pregnancy are issues that many American women face, these conditions can prove stigmatizing. Young women in the United States have especially high rates of unintentional pregnancy, and may worry about stigma for having an unexpected pregnancy in the first place, as well as stigmas related to the decisions that follow (parenting, adoption, or abortion). This may be a greater concern for women whose experiences are different from the norms within their communities.Even common experiences can make some people vulnerable to stigma. more...

“That’s the Hollywood secret! Don’t put food in your dumb mouth!” That’s how Amy Schumer, a 34-year-old comedian, mocks the tyranny of thinness in Hollywood and American society. As Schumer recounted on the television show Ellen, as she prepared for her film “Trainwreck,” movie executives hired a personal trainer to try to help her slim down. They gave her a meal plan that consisted of “a smoothie for breakfast, and then like for lunch you journal about that smoothie…like, there’s no food!”

At 5’7” and 160 pounds, Schumer’s Body Mass Index is 25.1, just barely over the current cut-off between “normal weight” and “overweight” and slightly below average for the current U.S. population. But she counts as heavy in Hollywood, where weight-based discrimination prevails and bigger bodies are devalued and rendered invisible in the contemporary United States. Unlike most women performers, Schumer has defiantly refused to resemble an “undernourished bird.” Her normal weight has not hurt her romantic life or her career. On its opening weekend, “Trainwreck,” the movie Schumer wrote and starred in, grossed $30 million. more...

In the recent Fisher v University of Texas case, the U.S. Supreme Court voted to affirm the Fifth Circuit’s decision to allow University of Texas to consider race in admissions. This is good news, because numerous studies have documented the positive impact of racial diversity on college campuses. This robust body of research was cited in an amicus brief from more than 800 academic scholars explaining the benefits of campus diversity. The dangers of ending affirmative action are also evident in California, where enactment of an anti-affirmative action state referendum in 1996 led to a steep decline in the number of black and Latino college students.

The Supreme Court’s decision to allow continued efforts to racially diversify college admissions is good news. But the bad news is that the decision will continue to encourage selective colleges and universities to frame such efforts in unintentionally limiting ways. Although the benefits of a diverse learning environment are clear, affirmative action overall was originally intended to further multiple goals: to promote greater access for African Americans into elite, predominantly white colleges; to make up for the historical effects of racial segregation; and (on many campuses) to counter previous policies of outright racial exclusion. Today’s students, however, hear little about these broad goals. Instead, students hear from colleges that affirmative action will benefit them. Most students have internalized this message, which has troubling implications for how America’s college students think about race and meritocracy. more...

One of the most important cases the Supreme Court reviewed this year was United States v. Texas, which ruled on challenges to two Obama administration initiatives – Deferred Action for Parents of Americans and Lawful Permanent Residents and an expanded Deferred Action for Childhood Arrivals program – that would have affected up to five million people. In November 2014, President Obama announced Executive Actions that included additional temporary protections for immigrants who arrived as children (also referred to as “DREAMERS”) and a new program for parents of U.S. citizens or lawful permanent residents. The programs would allow them to remain in the country and apply for work permits if they have been here for at least five years and have not committed felonies or repeated misdemeanors. These actions have been on hold since early 2015, when a district court issued a preliminary injunction in response to a challenge brought by Republican authorities in Texas and ultimately joined by 25 other states. The actual focus of the case was quite mundane: Texas argued that it would suffer significant financial damages if required to subsidize the cost of driver’s licenses to those qualifying for the s new programs. However, the larger context was an unwillingness to allow the President to enact policy change following years of blocked and failed efforts at immigration reform at other governmental levels.In November 2014, Obama announced Executive Actions that included temporary protections for immigrants who arrived as children and a new program for parents of U.S. citizens and lawful permanent residents to apply for work permits. These actions have been on hold since early 2015.

The Supreme Court was unable to reach a decision in June. The case resulted in a 4-4 tie, an unusual but not unexpected result given the current makeup of the court following the death of Justice Antonin Scalia and reflecting the politically divisive nature of the case. This means that the decisions of the lower courts remain in place and the two initiatives are blocked, for now. more...
