mechanism.\u00a0\u00a0 While that may or may not be true because you can&#8217;t prove a counterfactual, the ethical question remains.. &#8220;why shouldn&#8217;t content creators be compensated for their work?&#8221; \u00a0Don&#8217;t those who produce content and those who provide content have a right to monetize the web?<\/p>\n<p>Critics of SOPA point to the real danger that companies could be liberal with their efforts to &#8220;take down&#8221; sites that might be violating copyright and as a result unduly dampen the exercise of free speech on the web. \u00a0The basis of the on-line protests against <a href=\"http:\/\/socialmediacollective.org\/2012\/01\/17\/whats-the-difference-between-sopa-and-pipa\/\">SOPA and PIPA<\/a> was rooted largely in the belief that shutting down sites like <a href=\"http:\/\/en.wikipedia.org\/wiki\/The_Pirate_Bay\">PirateBay<\/a> and<a href=\"http:\/\/en.wikipedia.org\/wiki\/BitTorrent\"> BitTorrent <\/a>were akin to a <a href=\"http:\/\/en.wikipedia.org\/wiki\/Prior_restraint\">prior-restraint free speech violation<\/a>. \u00a0 An interesting <a href=\"http:\/\/www.ifap.ru\/library\/book495.pdf\">study<\/a>\u00a0by the Oxford Internet Institute finds an emerging global internet culture that increasingly sees Internet access as a fundamental right:<\/p>\n<p><a href=\"https:\/\/thesocietypages.org\/thickculture\/2012\/02\/16\/data-as-speech\/2012-02-16-11h22_37\/\" rel=\"attachment wp-att-4028\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-4028\" src=\"https:\/\/thesocietypages.org\/thickculture\/files\/2012\/02\/2012-02-16-11h22_37-400x279.png\" alt=\"\" width=\"400\" height=\"279\" srcset=\"https:\/\/thesocietypages.org\/thickculture\/files\/2012\/02\/2012-02-16-11h22_37-400x279.png 400w, https:\/\/thesocietypages.org\/thickculture\/files\/2012\/02\/2012-02-16-11h22_37-100x69.png 100w, https:\/\/thesocietypages.org\/thickculture\/files\/2012\/02\/2012-02-16-11h22_37.png 1108w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\" \/><\/a><\/p>\n<p>But the problem arises when you define &#8220;data&#8221; as &#8220;speech.&#8221; \u00a0Indeed, most data is speech. \u00a0But just like in the US where we have tiered level of speech protection (e.g. commercial speech has less protection than political speech), it would seem fair to suggest that content creators have a right to fully monetize their product. \u00a0This is the basis of liberal capitalism. \u00a0If you create a good, you should be entitled to be compensated for your labor. \u00a0But because the Internet is oblivious to the type of data being disseminated, treating data as speech becomes a challenging nut to crack. \u00a0It is preferable to an alternative view of data as product or data as commerce.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp;
