{"id":34868,"date":"2011-06-20T11:00:45","date_gmt":"2011-06-20T16:00:45","guid":{"rendered":"http:\/\/thesocietypages.org\/socimages\/?p=34868"},"modified":"2013-11-08T01:48:57","modified_gmt":"2013-11-08T06:48:57","slug":"the-data-behind-the-walmart-not-yet-class-action-lawsuit","status":"publish","type":"post","link":"https:\/\/thesocietypages.org\/socimages\/2011\/06\/20\/the-data-behind-the-walmart-not-yet-class-action-lawsuit\/","title":{"rendered":"The Data Behind the Walmart Gender Discrimination Lawsuit"},"content":{"rendered":"<p>Today the U.S. Supreme Court has announced that the female employees of \u00a0Walmart will not be allowed to bring a class action lawsuit against the company, arguing that it has not been shown that they are a class. \u00a0It would have been the largest employment discrimination suit in history.<\/p>\n<p>It seems timely, then, to re-post our summary of some of the evidence against Walmart. \u00a0Women are, on average, paid less, are less likely to be salaried, and hold lower-ranked positions than men. \u00a0This is true even though there is less turnover among women, meaning that the average female employee has been working at Walmart significantly longer than the average male employee.<\/p>\n<p style=\"text-align: center;\">&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;<\/p>\n<p>The U.S. Supreme Court is hearing arguments in the Dukes v. Wal-Mart suit. Wal-Mart is accused of egregious and systematic discrimination against the 1.5 million women who have worked there since 1998. \u00a0The case isn&#8217;t based on anecdotal accounts; instead, it&#8217;s backed up by <a href=\"http:\/\/www.walmartclass.com\/staticdata\/reports\/r2.pdf\" target=\"_blank\">reams of data<\/a>. \u00a0Here is some of it.<\/p>\n<p>Women in hourly and especially salaried jobs make less money than men:<\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/thesocietypages.org\/socimages\/files\/2011\/03\/212.jpg\" data-rel=\"lightbox-image-0\" data-rl_title=\"\" data-rl_caption=\"\" title=\"\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-34869\" alt=\"\" src=\"https:\/\/thesocietypages.org\/socimages\/files\/2011\/03\/212.jpg\" width=\"429\" height=\"300\" srcset=\"https:\/\/thesocietypages.org\/socimages\/files\/2011\/03\/212.jpg 613w, https:\/\/thesocietypages.org\/socimages\/files\/2011\/03\/212-500x349.jpg 500w\" sizes=\"auto, (max-width: 429px) 100vw, 429px\" \/><\/a><\/p>\n<p>Women are disproportionately in hourly jobs (instead of salaried jobs) in every district examined:<\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/thesocietypages.org\/socimages\/files\/2011\/03\/82.jpg\" data-rel=\"lightbox-image-1\" data-rl_title=\"\" data-rl_caption=\"\" title=\"\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-34875\" alt=\"\" src=\"https:\/\/thesocietypages.org\/socimages\/files\/2011\/03\/82.jpg\" width=\"375\" height=\"414\" \/><\/a><\/p>\n<p>Women make less than men in every district examined:<\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/thesocietypages.org\/socimages\/files\/2011\/03\/47.jpg\" data-rel=\"lightbox-image-2\" data-rl_title=\"\" data-rl_caption=\"\" title=\"\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-34871\" alt=\"\" src=\"https:\/\/thesocietypages.org\/socimages\/files\/2011\/03\/47.jpg\" width=\"405\" height=\"421\" srcset=\"https:\/\/thesocietypages.org\/socimages\/files\/2011\/03\/47.jpg 579w, https:\/\/thesocietypages.org\/socimages\/files\/2011\/03\/47-480x500.jpg 480w\" sizes=\"auto, (max-width: 405px) 100vw, 405px\" \/><\/a><\/p>\n<p>Women dominate the lowest paying, lowest ranked jobs at Walmart, and are a smaller and smaller percentages of the workforce as you go up the pay\/rank hierarchy (from right to left):<\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/thesocietypages.org\/socimages\/files\/2011\/03\/65.jpg\" data-rel=\"lightbox-image-3\" data-rl_title=\"\" data-rl_caption=\"\" title=\"\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-34872\" alt=\"\" src=\"https:\/\/thesocietypages.org\/socimages\/files\/2011\/03\/65.jpg\" width=\"394\" height=\"363\" srcset=\"https:\/\/thesocietypages.org\/socimages\/files\/2011\/03\/65.jpg 563w, https:\/\/thesocietypages.org\/socimages\/files\/2011\/03\/65-500x460.jpg 500w\" sizes=\"auto, (max-width: 394px) 100vw, 394px\" \/><\/a><\/p>\n<p>And this is true despite the fact that women have lower turnover and have, on average, been working at Walmart significantly longer:<\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/thesocietypages.org\/socimages\/files\/2011\/03\/72.jpg\" data-rel=\"lightbox-image-4\" data-rl_title=\"\" data-rl_caption=\"\" title=\"\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-34873\" alt=\"\" src=\"https:\/\/thesocietypages.org\/socimages\/files\/2011\/03\/72.jpg\" width=\"304\" height=\"266\" \/><\/a><\/p>\n<p>Walmart isn&#8217;t fighting the data. They&#8217;re not claiming non-discrimination. Instead, they&#8217;re arguing that compensation should be restricted to the women directly named in the suit instead of the 1.5 million women who&#8217;ve worked there. In other words, they&#8217;re hoping that the judge will not grant &#8220;class action&#8221; status to the case.
