{"id":572,"date":"2006-09-25T13:18:00","date_gmt":"2006-09-25T19:18:00","guid":{"rendered":"http:\/\/thesocietypages.org\/pubcrim\/2006\/09\/25\/why-put-that-amendment-first-2\/"},"modified":"2006-09-25T13:18:00","modified_gmt":"2006-09-25T19:18:00","slug":"why-put-that-amendment-first-2","status":"publish","type":"post","link":"https:\/\/thesocietypages.org\/pubcrim\/2006\/09\/25\/why-put-that-amendment-first-2\/","title":{"rendered":"why put that amendment first?"},"content":{"rendered":"<p><a href=\"http:\/\/sfgate.com\/cgi-bin\/article.cgi?f=\/c\/a\/2006\/09\/22\/MNGMTLANJR1.DTL&amp;hw=Mark+Fainaru+Wada+Lance+Williams&amp;sn=001&amp;sc=1000\"><img decoding=\"async\" alt=\"\" src=\"http:\/\/photos1.blogger.com\/blogger\/6608\/1089\/200\/reporters.jpg\" border=\"0\" \/><em>san francisco chronicle<\/em><\/a> writers mark fainaru-wada and lance williams face up to 18 months of federal prison time, pending appeal, for refusing to identify the source of leaked grand jury testimony in a steroid investigation involving barry bonds.<\/p>\n<p>18 months is a pretty long sentence (even in comparison to the clunky lead sentence written above). under the current <a href=\"http:\/\/www.msgc.state.mn.us\/Text%20Only\/sentencing_guidelines.htm\">minnesota guidelines<\/a>, someone with minimal criminal history would get 18 months or less for crimes such as simple robbery, residential burglary, theft greater than $2500, forgery, and sale of controlled substances.<\/p>\n<p>as a former journalist wannabe, i&#8217;m officially <a href=\"http:\/\/www.cpj.org\/attacks05\/pages05\/aop05index.html\">spooked<\/a>. <em>et tu, sports page<\/em>? this is supposed to be the &#8220;toy department,&#8221; not the trenches of modern journalism. it seems that <em>any <\/em>writers could find themselves neck-deep in such cases, with the possible exception of bridge columnists and sudoku contributors. as for this investigation, here are some of the major players:<\/p>\n<ol>\n<li><a href=\"http:\/\/www.tvsquad.com\/media\/2006\/03\/Barry-Bonds-rookie-card.jpg\">barry bonds<\/a>, the <a href=\"http:\/\/x8a.xanga.com\/6b5b867304c3046280413\/b27917444.bmp\">expanding<\/a> man. <\/li>\n<li><a href=\"http:\/\/news.bbc.co.uk\/sport1\/hi\/athletics\/4350810.stm\">victor conte<\/a>, who admitted distributing steroids to athletes and laundering the proceeds (sentenced to 4 months in prison and 2 years of court supervision for illegal drug distribution). <\/li>\n<li><a href=\"http:\/\/www.sfgate.com\/cgi-bin\/article.cgi?f=\/c\/a\/2006\/08\/28\/SPG32KQQB73.DTL&amp;hw=greg+anderson&amp;sn=001&amp;sc=1000\">greg anderson<\/a>, mr. bonds&#8217; trainer, who has already done 3 months after pleading guilty to dealing steroids and laundering money, plus 15 days for refusing to answer a previous grand jury&#8217;s questions.<\/li>\n<li><a href=\"http:\/\/abcnews.go.com\/Sports\/story?id=2477224&amp;page=3\">mark fainaru-wada and lance williams<\/a>, the reporters who are refusing to name names.<\/li>\n<li><a href=\"http:\/\/en.wikipedia.org\/wiki\/Judith_Miller_(journalist)\">judith miller<\/a>, former <em>new york times <\/em>reporter who did 3 months last year, after refusing to identify sources in a cia leak investigation.<\/li>\n<\/ol>\n<p>who do you think <u>will<\/u> ultimately do the <em>most <\/em>time as a result of the balco investigation? who, if anyone, do you think <u>should<\/u> do the most time?<\/p>\n<p>republican arlen specter has sponsored <a href=\"http:\/\/www.rtnda.org\/foi\/s2831.pdf\">senate bill s. 2831 &#8211; \u201cthe free flow of information act of 2006\u201d<\/a>, a &#8220;shield&#8221; law that might offer some protection for journalists in such situations &#8212; except for those <a href=\"http:\/\/www.nytstore.com\/ProdDetail.aspx?prodId=515\">seditious bridge columnists<\/a>, that is.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>san francisco chronicle writers mark fainaru-wada and lance williams face up to 18 months of federal prison time, pending appeal, for refusing to identify the source of leaked grand jury testimony in a steroid investigation involving barry bonds. 18 months is a pretty long sentence (even in comparison to the clunky lead sentence written above).
