The author is a graduate student at Harvard, and discusses the implicit assumption exhibited throughout the hearings that past Courts were uniformly just and impartial, and new courts somehow challenge this romanticized impartiality. He notes that there’s a pervasive idea, by focusing on the rhetoric of impartiality, that white men are automatically impartial. It’s a good read.

You criticize this commentary for being a misrepresentation of what “critics” (all critics? some critics? a few critics to whom you are referring?) have said, yet offer no evidence to support your argument. It seems that when someone like Senator Sessions states that heritage and experience can have no bearing on a judge’s work, he actually is talking about neutrality. He apparently is concerned that Sotomayor’s heritage might bias her decisions. Did Sessions (a white man) share this same level of concern that Alito’s heritage might bias his decisions? Maybe, but I doubt it. This is part of the point.

Yikes, what a misrepresentation of the what Sotomayor’s critics have said! Their charge is that Sotomayor is wrong when she says that a wise Latina would make BETTER choices than a white man. For a judge to say that is outrageous. Fortunately for her, she completely backtracked from her statements. What does it say about her initial thoughts that when push came to shove she couldn’t run from her comments fast enough?

right on, lisa. it reminds of that article titled “white men need not apply” that ran before Sonia Sotomayor was nominated. hello, white men, we could’ve ran a “anyone other than a heterosexual white man need not apply” article summing up the entire selection process for any political position since the dawn of our government.
